These Terms govern your use of GGmarket's website, APIs, messaging tools, checkout flows, wallet, and seller features. They are intentionally detailed so buyers and sellers understand rights, obligations, and enforcement standards before transacting.
By creating an account, listing items, making a purchase, or otherwise using GGmarket (the "Service"), you agree to these Terms of Service and our Privacy Policy. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization. If you do not agree, do not use the Service.
Certain product features (for example payment processing, dispute handling, or third-party integrations) can include additional terms shown at point of use. Where those terms conflict with this policy for that feature, the feature-specific terms control only for that feature.
You must meet the minimum age and legal capacity requirements in your jurisdiction to use the Service. You must provide accurate registration information and keep your account credentials confidential. You are responsible for all activity under your account unless you notify us promptly of unauthorized use.
We may restrict or terminate accounts that fail verification, violate sanctions laws, or appear connected to abuse networks. Identity checks may be performed through internal review or approved third-party providers.
GGmarket provides a venue for buyers and sellers to discover, negotiate, and complete transactions for digital goods. Unless we expressly state otherwise, we are not the seller of items listed by users. We may facilitate payments, messaging, or delivery workflows through partners, but the contract for each item is primarily between buyer and seller, subject to these Terms and our Marketplace Rules.
We may moderate listings, rank search results, investigate fraud, pause transactions, or require additional documentation where risk indicators exist. These actions are platform safety measures and do not create a fiduciary duty to any user.
As a buyer, you are responsible for due diligence before paying:
Buyers may not exploit obvious pricing errors, use stolen instruments, coordinate fraudulent claims, or pressure sellers into off-platform transactions that bypass protections.
Sellers must operate with commercial diligence and legal compliance:
Platform fees, payment processing costs, currency conversion, and payout schedules will be presented in the product or in a separate fee schedule. We may change fees with reasonable notice where permitted. Taxes may be collected or reported as required by law; sellers remain responsible for their own tax filings.
Refund outcomes depend on listing terms, delivery proof, and dispute evidence. We may issue full, partial, or no refunds based on our investigation and payment network requirements.
Final decisions may consider prior account behavior, technical telemetry, communication history, and payment network rules. Some payment reversals are mandatory under card-network policies and may not be appealable through the platform.
You agree not to:
Our Marketplace Rules provide additional operational detail and are incorporated by reference.
You retain ownership of content you submit. You grant us a worldwide, non-exclusive license to host, display, distribute, and technically process that content to operate and promote the Service. The Service's branding, software, and design are owned by us or our licensors and may not be copied except as allowed by law or express permission.
You represent that your listings, descriptions, and uploaded media do not infringe third-party rights. We may remove or restrict content where we receive valid infringement notices, legal demands, or credible abuse reports.
You are solely responsible for rights clearances, model releases, software licenses, and publisher permissions required for lawful sale or redistribution. We may ask for rights documentation and may suspend affected listings pending verification.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION OR THAT LISTINGS ARE LAWFUL OR ACCURATE — USERS ARE RESPONSIBLE FOR VERIFYING TRANSACTIONS AND COUNTERPARTIES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DIGITAL MARKETPLACE AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOSS OF PROFITS, DATA, OR GOODWILL. OUR AGGREGATE LIABILITY FOR CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE IN ANY TWELVE-MONTH PERIOD IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US IN FEES DURING THAT PERIOD OR (B) ONE HUNDRED DOLLARS (USD), EXCEPT WHERE LIABILITY CANNOT BE LIMITED BY LAW (SUCH AS GROSS NEGLIGENCE OR WILLFUL MISCONDUCT, WHERE APPLICABLE).
You will defend and indemnify GGmarket and its affiliates against claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your listings or purchases, your violation of these Terms, or your violation of third-party rights.
This indemnity includes costs related to regulatory inquiries, payment disputes, consumer complaints, and intellectual property allegations caused by your conduct, to the extent permitted by applicable law.
We may suspend or terminate access to the Service, remove listings, or withhold payouts where we reasonably believe there is risk of harm, fraud, or legal exposure, or where required by law. You may close your account subject to completion of open obligations. Provisions that by their nature should survive (including liability limits, indemnity, and dispute terms) will survive termination.
Most concerns should first be handled through account support and order dispute workflows. If a dispute cannot be resolved, each party agrees to attempt informal resolution in good faith before starting legal action in the jurisdiction that applies under local law.
These Terms constitute the entire agreement regarding the Service and supersede prior understandings on the same subject. If a provision is unenforceable, the remainder stays in effect. Failure to enforce a provision is not a waiver. We may assign these Terms in connection with a merger or sale; you may not assign without our consent. Notices may be sent to the email on your account or posted in-product.
